Terms of Service

Last updated: 30th August 2026

01 ·Agreement to These Terms

These Terms of Service ("Terms") are a binding agreement between you and Klientscale Ltd ("Klientscale", "we", "us"), located at 86-90 Paul Street, London, EC2A 4NE. By purchasing, accessing or using any Klientscale product, website or service, you agree to these Terms. If you do not agree, do not purchase.

You must be at least 18 years old, or the age of majority where you live, to purchase.

02 ·The Products

Klientscale sells digital products and optional services:

AI Lead Reactivation Playbook ($27) — a digital playbook delivered as an online membership, including build guides, a GoHighLevel snapshot import link, a messaging framework and opener bank, a knowledge base template, a Europe compliance pack, and supporting materials.

AI Receptionist Add-On ($19) — an optional order bump, delivered the same way.

1:1 Build Review ($37) — an optional order bump. A single 30-minute video call, scheduled by you via the booking link provided after purchase.

Done-For-You Setup ($247) — an optional one-time offer. A fixed-scope configuration service performed in your own GoHighLevel account. Governed additionally by Section 10.

Delivery is digital and immediate. After a successful purchase, access details are sent to the email address you provide at checkout. Nothing is shipped. If you have not received access within 30 minutes, check your spam folder and then contact [email protected].

Our digital products are educational. They teach a process implemented using third-party platforms you subscribe to separately. We are not affiliated with, endorsed by or sponsored by GoHighLevel or any other platform referenced. Those platforms have their own costs, terms and policies, which are your responsibility.

03 ·Your Licence

We grant you a personal, non-exclusive, non-transferable licence for one person and one business.

You may use the playbook, snapshot, prompts and templates to build and operate the system in your own business, and adapt any of it to your circumstances.

You may not resell, redistribute, share, publish or give away the playbook, the snapshot, the prompt files, the opener bank or any other material — whether free or paid, in whole or in part. You may not repackage the system as your own course, template pack or product. You may not share your login. One purchase is one user.

Additional builds. The licence covers one business, one location and one brand. If you operate multiple businesses or locations, contact us.

Agencies. This licence does not permit you to implement the system for clients as a paid service. If you want to do that, contact us about a separate arrangement.

The short version: use it in your business; don't redistribute the kit. Breaching this licence terminates it immediately and without refund.

04 ·Payments, Pricing and Tax

Payments are processed by our payment provider. We never see or store your full card details. Prices are displayed in the currency shown at checkout.

Order bumps and one-time offers are optional, clearly priced before you confirm, and charged only if you accept them. When you accept a one-time offer after checkout, that charge is made to the payment method used for your original order, as disclosed on that page.

You are responsible for any taxes applicable where you live, save where we are required to collect them, in which case they are shown at checkout.

05 ·Right of Withdrawal (UK and EU Consumers)

If you are a consumer in the UK or the EU, you normally have a 14-day right to withdraw from a distance contract.

For digital content supplied immediately, that right is lost where you have given express consent to immediate supply and acknowledged that you thereby lose the right of withdrawal. You give that consent by ticking the relevant box at checkout, which is required before your order can be placed.

This does not affect our voluntary guarantee in Section 06, which is more generous than your statutory rights and is offered in addition to them. Nothing in these Terms limits your statutory rights as a consumer.

06 ·Our 30-Day Guarantee

The guarantee: build the system as described in the playbook, run it on your own database, and if it does not put at least one appointment in your calendar within 30 days of your first send, we will refund you in full. You keep your access to the playbook.

This is a voluntary commercial guarantee offered in addition to your statutory rights. It is a guarantee that the system works when you run it — not a trial period, and not a refund for deciding not to implement.

To claim it, email [email protected] with the following evidence from your GoHighLevel account:

  1. The workflows — a screenshot showing the Start workflow published, with the number of contacts enrolled
  2. The campaign — a screenshot of your Conversations view showing messages sent, with dates, to at least 200 contacts from your own database, or to your entire eligible list where that list is smaller than 200
  3. The dashboard — a screenshot of your Opportunities pipeline showing the stages and their counts, evidencing that no contact reached the booked-appointment stage
  4. Your number — confirmation that your phone number registration was approved and active during the campaign

Screenshots must be unedited and show your account interface. In place of screenshots we may accept a short screen share, or temporary read-only access, at your option.

Timing. The 30-day period runs from your first send — the date the system first sends messages to your contacts — because number registration timelines vary by country and are outside your control and ours.

Outer limit. Claims must be submitted within 90 days of purchase, whether or not you have sent by then. If you have not begun sending within 55 days of purchase, the guarantee expires. It is a guarantee that the system produces results when you run it, not an open-ended option.

Where registration is the delay. If your number registration is still pending at the 90-day mark, contact us before that date and we will extend the window. We will not penalise you for a carrier queue — but we do need to hear from you.

Response. We will acknowledge your claim within 2 business days and may ask one round of clarifying questions. Please respond within 7 days. Approved refunds are made to the original payment method, normally within 5–10 business days.

What does not qualify. A claim will be declined where the system was not built as described, where fewer than 200 contacts (or your entire eligible list) were messaged, where the phone number was never approved, where the evidence above is not provided, or where an appointment was booked and subsequently cancelled or not attended.

Order bumps and services. This guarantee applies to the $27 playbook and the $19 receptionist add-on. The 1:1 Build Review is refundable only if unused and unscheduled. The Done-For-You Setup is governed by Section 10.

Abuse. We may decline a refund in cases of clear abuse — repeated purchase-and-refund cycles, licence violations, fabricated evidence, or claims where the stated conditions are plainly untrue.

07 ·Chargebacks

If you have a problem, email us. We will usually resolve it faster than your bank will.

Initiating a chargeback without first contacting us, in circumstances where our guarantee would have applied, is a breach of these Terms. In that event we may terminate your licence and access, and decline future purchases. We reserve the right to submit these Terms, your checkout consent record and your account activity as evidence in any dispute.

08 ·Results Disclaimer

We make no promise about your results, revenue, appointments, reply rates or conversion rates.

Any figures shown on our pages — reply rates, booked-appointment rates, revenue examples, build times — are either our own results or benchmark ranges, shared as examples. They are not typical, not a guarantee, and not a projection of what you will achieve.

Your outcome depends on the size and quality of your database, how it was collected, your offer, your market, your follow-up, and factors nobody controls. A dormant database that is small, old, poorly recorded or collected without a proper basis may produce little or nothing.

Nothing on our pages or in our products is financial, legal or professional advice.

09 ·Your Compliance Responsibilities and Spam Complaints

Read this section carefully. It allocates risk that sits with you.

9.1 You are the sender

Our products help you send messages to contacts in your own database, from your own account, using your own phone number, under your own business name. We do not send messages. We do not select recipients. We do not supply, verify or enrich contact data.

Every message sent from your account is sent by you, as sender and as data controller.

9.2 Your warranties

By using the products you warrant that, for every contact you message:

  • You hold a lawful basis and any consent required in that contact's jurisdiction
  • The contact provided their details to you directly, and you have not purchased, scraped or otherwise acquired them from a third party
  • You have honoured every opt-out, objection and suppression request you have received
  • Your sender identity and phone number are registered as required by the relevant carrier and regulator
  • Your messages comply with all applicable law, including any obligation to disclose that a communication is automated or AI-generated

9.3 Spam complaints, carrier action and number suspension

We are not liable for spam complaints or anything arising from them.

You accept sole responsibility for, and we expressly exclude all liability for:

  • Spam, abuse or unsolicited-message complaints made against you, by recipients, carriers, regulators or any other party
  • Any resulting filtering, throttling, blocking, suspension or permanent termination of your phone number, sender ID, short code, domain or messaging account, whether by a carrier, an aggregator, GoHighLevel or any other provider
  • Loss of a phone number, its reputation, or your ability to send messages at all
  • Suspension or termination of your account with any third-party platform
  • Any resulting interruption to your business, loss of revenue, loss of contacts or loss of goodwill

This applies regardless of whether you followed our materials, and regardless of whether your sending was in fact lawful. Carriers act on complaint volume, not on legality. A campaign can be entirely compliant and still result in a blocked number. That risk is inherent to SMS marketing and it is yours.

9.4 Regulatory complaints, claims and penalties

You are solely responsible for any complaint, investigation, enforcement action, fine, penalty, statutory damages claim, group or class action, or civil claim arising from messages sent from your account — including under PECR and UK GDPR, the GDPR and national ePrivacy implementations, or the rules of any other jurisdiction in which your recipients are located.

We will have no liability for any of it.

9.5 Our materials are guidance, not advice

The Europe Compliance Pack and any compliance content in our products are general guidance written by non-lawyers. They are not legal advice, have not been reviewed against your database, consent records, sector or markets, and do not constitute an assessment of whether any particular contact may lawfully be messaged.

You are responsible for taking your own legal advice. We recommend you do so before sending to a large list, in a regulated sector, or in a market where you do not operate.

9.6 Whose account, whose data

9.6.1 — Self-serve products. We never access your contact data. It is imported by you, into your own account, and we have no visibility of it.

9.6.2 — Done-For-You Setup (standard). The Done-For-You Setup is performed in your own GoHighLevel account, which you hold in your own name and pay for directly. We do not resell, host or provide the platform. You grant us a temporary user seat so we can perform the configuration; you may revoke it at any time, and we ask you to revoke it once the build is handed over.

Throughout, you remain the account holder, the sender and the data controller. Your contact data is imported into your account. Your phone number is registered in your name and to your business details. Messages are sent from your account, under your business identity. We configure the system; we do not operate it, and we do not send messages on your behalf.

We act solely on your instructions. We do not retain copies of your data, do not use it for any other purpose, and delete or return anything shared with us on request. You remain responsible for the lawfulness of the data you provide to us, for your instructions as to which contacts are included, and for all messages subsequently sent from your account.

9.6.3 — Where we host on our own infrastructure (by exception). Where we agree in writing to operate the system on a sub-account or infrastructure controlled by us, all of the following apply:

  • We act as a service provider carrying out implementation work on your documented instructions. You remain the data controller; we act only as a processor. You determine which contacts are messaged, what is said to them and to what end.
  • You supply the data. You import it, or provide it to us for import, and you warrant that you have the lawful basis and consent required under Section 9.2 for every contact in it. We do not verify, source, enrich or supplement it.
  • You instruct the sending. No campaign is sent without your written approval of the audience, the message content and the schedule. We do not decide who is contacted.
  • Your sender identity. The phone number, sender ID and any carrier or regulatory registration must be registered to your business details, and messages must identify your business as the sender. We will not send under our own registered sender on your behalf.
  • A written Data Processing Agreement must be in place before any personal data is transferred to us, setting out the subject matter, duration, nature and purpose of processing, the categories of data and data subjects, our obligations of confidentiality and security, our use of sub-processors, our assistance with data-subject requests, and deletion or return of data on termination. Where no such agreement is in place, we will not accept your data.
  • Purpose limitation. We process your data only to perform the agreed service. We will not use it for our own purposes, will not market to your contacts, will not combine it with any other dataset, and will not disclose it except as you instruct or as law requires.
  • Access and deletion. Your data is segregated to your engagement. On termination we delete or return it, at your election, and confirm in writing.
  • Responsibility for the campaign is unchanged. Sections 9.2 to 9.5 and 9.7 apply in full. You remain responsible for the lawfulness of the messages sent, and we remain not liable for spam complaints, carrier action, regulatory action or any claim arising from them, notwithstanding that the sending was carried out on infrastructure we control and at your instruction.

9.7 Indemnity

You will indemnify and hold us harmless against any claim, complaint, penalty, fine, cost or expense — including reasonable legal fees — arising from messages sent from your account, the data you process, or any breach of this Section 09. This is in addition to Section 15.

9.8 What we will do

If you receive a complaint we will, on request and as a courtesy, help you understand what happened and what to change. That assistance is not an admission of liability and does not make us a party to the matter.

10 ·Done-For-You Setup

Where you purchase the Done-For-You Setup, the following applies in addition to these Terms.

Your platform account. The Done-For-You Setup is performed inside your own GoHighLevel account. You must hold an active GoHighLevel subscription in your own name and business details before work begins; we can provide a signup link, which is an affiliate link as disclosed in Section 11. We do not provide, resell or host the platform, and your subscription, its cost and its terms are between you and GoHighLevel. Where we agree by exception to work on infrastructure controlled by us, Section 9.6.3 applies and a separate written agreement is required.

Scope. A fixed-scope configuration of the system inside your account, as described on the offer page at the time of purchase. It is a build, not an ongoing service.

What you provide. Intake answers, your contact list, calendar access and a user seat on your account, within 7 days of purchase. If we do not receive these within that period, your build slot is released and rescheduled to the next available slot.

Timing. We will configure, test and queue your system within three business days of receiving everything we need. We do not control how quickly a carrier or regulator approves your number registration, and we make no commitment as to when your system will begin sending.

Not included. Ongoing management; data cleaning beyond deduplication; third-party costs including your platform subscription and messaging credits; more than one business, location or brand; integrations beyond your calendar; messaging in languages other than English; and any guarantee of results or of registration approval.

Refunds. Because this is a service performed to your specification, it becomes non-refundable once work has begun. Before work begins, it is fully refundable. Where we cannot proceed because you have not supplied what we need within a reasonable period after the 7-day window, we may treat the engagement as complete.

11 ·Third-Party Tools and Affiliate Disclosure

The system is built on GoHighLevel, which you subscribe to separately and at your own cost. We use affiliate links. If you sign up through our link we may receive a commission at no additional cost to you. This is disclosed on our sales pages and does not change what you pay.

We do not control third-party platforms. Their features, pricing, policies and interfaces change, and we update our materials on a reasonable-efforts basis. We do not warrant that any third-party tool will continue to work as our materials describe.

12 ·Intellectual Property

All product content — playbooks, guides, snapshots, workflows, prompts, templates, opener banks, frameworks, copy and branding — is owned by Klientscale Ltd and protected by copyright. Your licence in Section 03 is the full extent of the rights granted.

Third-party names are trademarks of their respective owners, used only to describe compatibility.

What you build is yours. The configured system in your account, the messages you send and the customers you win belong to you.

13 ·Acceptable Use

You agree not to use our products to build or send anything unlawful, deceptive, misleading or harmful. This includes messaging people who have not consented or with whom you have no lawful basis, misrepresenting who you are, denying that an automated agent is automated where disclosure is required, or making claims you cannot substantiate.

What you send is your responsibility.

14 ·Disclaimers and Limitation of Liability

Our products are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose.

To the maximum extent permitted by law, our total liability for any claim arising out of these Terms or your purchase is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost data, lost contacts, business interruption, carrier action or regulatory penalties.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15 ·Indemnification

You agree to indemnify and hold harmless Klientscale Ltd, its officers and contractors from claims arising out of your use of the products, your violation of these Terms, the messages you send, or the data you process.

16 ·Changes to These Terms

We may update these Terms. The "Last updated" date reflects the current version. Material changes will be posted on this page. Changes do not apply retroactively to purchases already made.

17 ·Governing Law and Disputes

These Terms are governed by the laws of England, without regard to conflict-of-law rules.

If you are a consumer in the UK or EU, this does not deprive you of the protection of mandatory consumer-protection provisions of the law of your country of residence, and you may bring proceedings in your local courts.

Before filing any claim, contact us at [email protected] and give us 30 days to resolve it. Most things are fixable by email.
